The emails referenced here are for purposes other than eVoting. So if you note here that we have your email and you did not consent to eVoting that's because this list is for surveying or polling and general community communications not legal eVoting like elections. Most of the community has the same email for for eVoting and all email communications. For people who did not consent to electronic voting, legal voting and elections will have paper ballots mailed as in the past to them. We do not mail paper Surveys. Three lots are in purple. To the best of our knowledge, these lots were part of an error the developer made in the early days of the subdivision that involved all the lots on M-Cari Lane. Somehow they were not included in the governing documents making them not subject to any of the controls of the association. Subsequent Board of Directors have attempted to remedy this problem by having those owners sign a "Consent to Declaration of Protective Covenants" document effectively binding them to the same covenants all of Sugarhill is subject to.
Three owners refused to sign the document. They are, therefor, not a part of the association. However, litigation ensued where the annual Maintenance Fee would have to be paid by them because access to their properties is on the Association's privately maintained roads and they get their mail through association owned mail boxes. Because they are not a part of the association they can not vote in elections or use common grounds and they can not benefit from any drainage issues that arise. The 2019 Board of Directors had no involvement with the current status or outcome of this matter.
Sugarhill residence should not use any activity on these lots as precedent for covenant change example. These homes or lots must answer to Martin County Code Enforcement.
It should be noted that it is our intent is to have this issue corrected. It was an error caused by the developer and the first board of directors failing to do the final steps of the technical legal paperwork required. This technical error is certainly correctable and is in the process of meeting the intention of full inclusion in Sugarhill Property Owners Association. That is the reason we highly recommend these owners comply with Sugarhill POA Covenants while this correction is being instigated and reviewed.

Electronic surveys are available to all properties that pay assessment fees providing we have their email. Electronic elections are available to all properties that are members of the Association.
